Sedalia Police responded to the 500 block of West Morgan Street in reference to a domestic assault Wednesday morning. On arrival, Officers made contact with the subject. After an on-scene investigation, a primary aggressor was identified. Cody L. Bergman, 25, of Sedalia, was arrested for felony Domestic Assault in the 3rd Degree, and Endangering the Welfare of a Child in the 2nd Degree. Bergman was transported to the Pettis County Jail to be placed on a 24-hour hold.

According to the probable cause statement, the incident occurred when the victim drew a penis on Bergman's back.  After a verbal argument, he headbutted the victim while their child was in the room.  Officers noted that they did see scratches on Bergman's neck, which were consistent with injuries sustained from fingernails.  The probable cause statement also notes that Bergman had several scratches on his neck.

Bergman was convicted of felony Murder in the 2nd Degree, and felony Armed Criminal Action in 2014 for the murder of his stepfather, 41 year old William Capps, in 2011, when he was 13.  Bergman’s sentence of 20 years was served in dual jurisdiction, and he was placed with other juveniles through the age of 21.   When Bergman turned 21 in 2018, he was placed on probation for five years.  That probation, which was violated twice in 2019, was scheduled to conclude on 11/18/2023.

Bergman was given a cash or surety bond of $3500, and ordered to have no contact with the victim.
